Terms of Service

1. Ownership and Operation

MostXclusive, a limited liability company based in Toronto, owns and operates www.mostxclusive.com and all affiliated websites and mobile versions (collectively, “MostXclusive”).
This social media platform allows creators to upload photos and videos and set prices for access to their content. Fans can pay to access this content.

“You” or “User” refers to both Creators and Fans.

 

2. Agreement to Terms

By using MostXclusive, you agree to be bound by these Terms of Service. Please read these Terms carefully, especially the sections on disclaimers of warranties, limitations of liability, releases, class action waivers, mandatory arbitration, and disputes.

If you do not agree, you must not use MostXclusive.

 

3. Changes to Terms

We may update these Terms occasionally. Changes will be effective from the “last update” date on this page and will not apply retroactively to ongoing disputes. While we may attempt to notify you of changes, it is your responsibility to check this page regularly.

Continued use of MostXclusive after changes are posted constitutes acceptance of the revised Terms. If you disagree with the revised Terms, stop using MostXclusive.

 

4. General Provisions

a. No Minors – MostXclusive is strictly for adults aged 18+ who have reached the age of majority in their jurisdiction.
b. Parental Controls – Tools are available to limit minors’ access to harmful material.
c. No CSAM – Child Sexual Abuse Material is strictly prohibited. Report violations immediately to contact@mostxclusive.com.
d. No Prostitution or Sex Trafficking – Strictly forbidden.
e. User Content – Users retain ownership of uploaded content; MostXclusive does not own it. Content is provided “AS IS.”
f. Company Rights – We reserve the right to modify, suspend, or terminate the platform; restrict access; remove non-compliant content; investigate violations; and cooperate with law enforcement.

 

5. License to Use

You are granted a conditional, revocable, non-transferable, non-sublicensable, non-exclusive, limited license to use MostXclusive for personal, lawful purposes.

 

6. Accounts

  • Fans – Must provide valid registration details and payment method.

  • Creators – Must be verified and provide additional legal/banking info. Biometric verification may apply.

  • User Certifications – You certify your information is accurate and you won’t resell or transfer accounts.

  • Your Content – You retain ownership but grant MostXclusive a license to use and display content as needed.

  • Co-Authored Content – Requires documentation and consent from all parties.

  • Deactivation – Can be done anytime via account settings.

 

7. Purchases & Payments

  • Subscriptions auto-renew until canceled.

  • Wallet funds are non-refundable.

  • Trials convert to full subscriptions unless canceled.

  • Refunds are generally not provided.

  • Virtual currency may be accepted but is non-refundable.

  • Creators earn 80% of revenue (after chargebacks/violations).

  • Referral program available under specific terms.

  • Inactive accounts incur a $5 monthly deduction until balance is zero.

 

8. Acceptable Use

You must not use MostXclusive for unlawful, harmful, or prohibited activities, including but not limited to:

  • Sharing CSAM, revenge porn, bestiality, non-consensual content, or illegal activity.

  • Fraud, impersonation, spamming, or malicious software.

  • Extortion, harassment, hate speech, or human trafficking.
    Violations may result in immediate suspension, termination, or legal action.

 

9. Third Party Websites

  • Integration with Twitter/X requires compliance with their policies.

  • Linking to MostXclusive must not suggest endorsement without consent.

  • We are not responsible for third-party sites linked from MostXclusive.

 

10. Intellectual Property

  • Except for User Content, all platform content is owned by MostXclusive or its licensors.

  • The name, logo, and related branding are trademarks of MostXclusive.

 

11. Disclaimer of Warranties

MostXclusive is provided “AS IS” with no warranties of any kind. Your use is at your own risk.

 

12. Limitation of Liability

The Company will not be liable for:

  • Errors or inaccuracies of content.

  • User conduct or content.

  • Viruses, malware, or technical failures.

  • Losses, delays, or damages of any kind beyond $100 USD or the amount you paid to the Company (whichever is greater).

 

13. Complaints

  • Report violations to contact@mostxclusive.com with details.

  • Appeals may be submitted via the same contact.

  • Copyright disputes handled under DMCA Policy.

 

14. Disputes

  • Governed by Ontario, Canada law.

  • Disputes resolved through negotiation, mediation, or binding arbitration in Toronto, unless litigation is specifically allowed.

  • Jury trial and class action rights are waived.

 

15. Miscellaneous

  • Entire agreement between you and MostXclusive.

  • Assignments require written approval.

  • Notices sent to contact@mostxclusive.com.

  • No waivers unless written.

  • Force majeure protections apply.

  • Electronic communications are legally binding.

  • All services and communications in English.

 

16. Content Review

All uploaded content is subject to review and may be approved, rejected, or modified to comply with policies.

 

17. Appeals Policy

If you appear in any content and wish to appeal removal, contact contact@mostxclusive.com. Neutral resolution will be provided if needed.
