MostXclusive (“MostXclusive,” “we,” “us,” or “our”) owns and operates www.mostxclusive.com and all related websites and mobile versions (collectively, the “Site”) and the services offered thereon (the “Services”). We value your privacy and are committed to safeguarding it through this Privacy Policy (the “Policy”).

By accessing or using the Site/Services, you consent to this Policy and agree to our practices for collecting, using, disclosing, retaining, and protecting your information.

We may revise this Policy at any time. Changes are effective upon posting with the updated “Last Updated” date. Your continued use after changes constitutes acceptance, so please check this page periodically.

 

2) Minimum Age Requirement

The Site and Services are for adults only. You must be at least eighteen (18) years old (and the age of majority in your jurisdiction) to access or use the Services.
We do not knowingly market to, collect, or solicit information from anyone under 18. If we learn we collected information from a person under 18, we will promptly delete it.

  • Government IDs / KYC: driver’s license, passport, or other identification numbers (as required for Creator verification, tax, or compliance).

  • Biometric Information (Creators/verification): retina or iris scans, fingerprints, voiceprints, or hand/face geometry derived from content or verification documents you provide.

  • Financial/Transaction Data: order history, purchase records, subscription history (we do not store full payment card numbers—processors handle this).

  • Network/Device Data: log data, device identifiers, browser type/version, referring/exit pages.

  • Characteristics/Protected Classifications (if voluntarily provided or inferred as required by law): e.g., age verification.

  • Inferences/Preferences: interests or features you interact with, content preferences.

Not covered: de-identified or publicly available information.

 

4) How We Collect Your Personal Information

We collect information:

Directly from you, for example via:

  • Account registration and profile setup;

  • Content uploads, co-authorship attestations, and releases;

  • Purchases, subscriptions, tips, and other transactions;

  • Search queries and on-site interactions;

  • Connections to social media accounts;

  • Surveys, forms, support requests, email, SMS, phone, mail, or messages (including on third-party platforms).

Automatically, via:

  • Cookies, pixels, SDKs, and similar technologies gathering device, usage, and analytic data.

From third parties, such as:

  • Payment processors, identity and age-verification providers, analytics providers, ad tech partners (where applicable), and anti-fraud vendors.

This Policy does not extend to information collected offline or by unaffiliated third parties via links accessible on the Site.

Do Not Track (DNT): Industry standards are not uniform; we currently do not respond to DNT signals.

 

6) Third-Party Collection on the Site

Their collection/use is governed by their own terms and privacy policies. We do not control third-party tracking technologies.   • Account & Content: You can update profile details and adjust privacy settings. You may delete content containing personal information or request account deletion. We may retain certain data as permitted by law (e.g., fraud prevention, legal, tax, or security).

  • Cookies: Manage through browser/device settings. Blocking cookies may impair features.

  • Marketing: Where applicable, you may opt out of non-transactional marketing per instructions in the message or in your account settings.

  • Interest-Based Ads: See third-party opt-out mechanisms offered by those providers (if applicable in your region).

We may decline requests that would violate law or result in incorrect information.

 

10) Data Retention

We retain personal information only as long as necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce agreements. We may retain de-identified and publicly available data for legitimate business purposes.

 

11) Security

However, transmission over the Internet is not completely secure; any transmission is at your own risk. We are not liable for circumvention of privacy or security settings.

13) International Users & Data Transfers

If you access the Services from outside our home jurisdiction (Canada), you understand your information may be transferred to, stored, and processed in Canada, the U.S., and other countries where our service providers operate. Those jurisdictions may have different (and potentially less protective) data protection laws than your country.

 

14) U.S. State Privacy Notices

Nevada

We currently do not meet the criteria under Nevada Revised Statutes Chapter 603A and do not sell personal information. If this changes, Nevada residents may submit an opt-out request to contact@mostxclusive.com.

Virginia / Colorado

At this time, we do not meet the statutory thresholds under these laws. If that changes, we will update this Policy and honor applicable rights. You may always manage certain information in your account.

California (CCPA/CPRA)

This notice supplements the Policy for California residents.

Categories Collected (past 12 months):

  • Identifiers (e.g., name, email, IP);

  • Customer records (Cal. Civ. Code §1798.80(e), e.g., payment records via processors);

  • Biometric information (Creators/verifications);

  • Internet/network activity (e.g., browsing data);

  • Commercial information (purchase/subscription history);

  • Inferences about preferences.

Sources: directly from you, automatically from your device, and from service providers/partners.

Business Purposes: as described in Section 7 (use cases) and Section 8 (sharing).

Sharing/Disclosure: to service providers and recipients of cookie data (e.g., analytics).
Sales/Sharing for Cross-Context Behavioral Advertising: We do not sell personal information. If we begin to “share” under CPRA definitions, we will provide required opt-out mechanisms.

Your Rights (subject to verification and exceptions):

  • Right to Know/Access the categories and specific pieces collected;

  • Right to Delete;

  • Right to Correct;

  • Right to Non-Discrimination;

  • Right to Opt-Out of Sale/Sharing (if applicable in future);

We aim to respond within 45 days (extendable once by another 45 days with notice). You may make two access/portability requests per 12-month period. We will verify your identity and authority before acting on a request.

Shine the Light: We do not disclose personal information to third parties for their direct marketing purposes.

 

15) Canada (PIPEDA) – Canadian Privacy Policy

We adhere to PIPEDA principles regarding collection, use, and disclosure of personal information of Canadian residents.

Your Rights in Canada include:

  • Access to your personal information we hold;

  • Request corrections;

  • Withdraw consent to collection/use/disclosure (subject to legal/contractual restrictions and reasonable notice).

Use & Sharing: We collect, use, and disclose personal information solely for identified purposes, with consent or as otherwise permitted by law. We do not share personal information with third parties for direct marketing without your explicit consent.

16) Children’s Privacy

We do not knowingly collect personal information from individuals under 18. If you believe we have inadvertently collected such information, contact contact@mostxclusive.com and we will delete it.

We may amend this Policy at our discretion and at any time. When we make changes, we will post the updated Policy on the Site and update the “Last Updated” date. Your continued use after posting constitutes acceptance.
