DMCA Notice and Takedown Policy

MostXclusive, operated by OnlyTheXclusive Inc. (“MostXclusive,” “we,” “our,” or “us”), qualifies as a Service Provider under the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. §512. We respect the intellectual property rights of others and expect our users to do the same. In accordance with the DMCA, we (a) respond to proper notices of alleged infringement, (b) remove or disable access to infringing material, and (c) terminate, where appropriate, accounts of repeat infringers.

Use this contact only for copyright/DMCA matters. For general support, also use support@mostxclusive.com with a clear subject line (e.g., “DMCA NOTICE” or “DMCA COUNTER-NOTICE”).

 

2) How to Send a DMCA Notice of Claimed Infringement

If you believe content on MostXclusive infringes your copyright, send a written DMCA Notice to the Designated Agent that includes all six elements required by 17 U.S.C. §512(c)(3):

  1. Signature of the copyright owner or authorized agent (physical or electronic).

  2. Identification of the copyrighted work claimed to be infringed (or a representative list for multiple works).

  3. Identification of the infringing material and its location on MostXclusive (provide specific URLs).

  4. Your contact information (full name, mailing address, telephone number, and email).

  5. Good-faith statement that the use is not authorized by the owner, its agent, or the law.

  6. Accuracy statement under penalty of perjury that you are the owner or authorized to act on the owner’s behalf.

Incomplete notices may delay processing. If substantially compliant, we may request additional information so your notice meets §512 requirements.

 

3) Abuse & Misrepresentation

Submitting false claims or material misrepresentations in a DMCA Notice or Counter-Notice may result in liability for damages (including costs and attorneys’ fees) under 17 U.S.C. §512(f). We investigate abuse of this process and may take appropriate legal or account actions.

 

4) What We Do Upon Receiving a Proper Notice

  • Promptly remove or disable access to the allegedly infringing material.

  • Notify the uploader (the “Affected User”) of the takedown.

  • Where appropriate, terminate repeat infringers in accordance with our repeat-infringer policy.

  • Maintain a record of notices/counter-notices as required for safe harbor.

 

5) How to Send a Counter-Notification (If Your Content Was Removed)

If you believe your material was removed due to mistake or misidentification, send a Counter-Notification pursuant to 17 U.S.C. §512(g) that includes:

  1. Your signature (physical or electronic).

  2. Identification of the material removed or disabled and the location (URL) where it appeared before removal.

  3. Good-faith statement under penalty of perjury that the removal/disablement was a mistake or misidentification.

  4. Your contact information (full name, mailing address, telephone number, and email).

  5. Consent to jurisdiction of the U.S. federal district court for your address, or if outside the U.S., any U.S. federal district court where MostXclusive may be found, and your agreement to accept service of process from the original complainant or their agent.

6) What Happens After a Counter-Notification

  • We forward your Counter-Notification to the original complainant.

  • Unless the complainant informs us within 10 business days that they have filed an action seeking a court order to keep the material down, we may restore the material.

  • Restoration does not waive our right to remove content again upon new valid notices.

 

7) Language Requirement

All DMCA Notices and Counter-Notifications must be submitted in English. Non-English submissions may not be processed.

 

8) Repeat Infringer Policy

In appropriate circumstances, MostXclusive will terminate accounts of users determined to be repeat infringers.

 

9) Policy Changes

We may amend this DMCA Policy at any time. Updates will be posted here with a revised “Last Updated” date.

 

10) Non-DMCA Requests

The DMCA contact is only for copyright matters. For billing, access, or general support, email support@mostxclusive.com with an appropriate subject line (e.g., “Account Support”).
